Debt Cue Financial Consultation Meeting

Debt counselling (also known as debt review) is a formal, legally regulated debt relief process established under the National Credit Act. A registered debt counsellor assesses your financial situation and restructures your debt into a single, affordable monthly instalment based on what you can realistically afford after essential living expenses.

The fees are strictly regulated by the National Credit Regulator (NCR) so that counsellors cannot overcharge. The standard fee structure includes:

  • Application Fee: R50 (excl. VAT)
  • Administration Fee: R300 (excl. VAT)
  • Restructuring Fee: A once-off fee equal to your first month's restructured payment, capped at a maximum of R8,000.
  • Monthly After-care Fee: 5% of your monthly payment, capped at R450 per month.

Generally, no. You must have a regular, verifiable source of income (such as a salary, pension, or business revenue) to fund a restructured payment plan.

The exception: If you are married in community of property and your spouse is employed, or if you can prove a guaranteed, steady alternative income stream (like regular financial support from a relative or rental income), you may still qualify.

It provides legal protection for your assets (like your car and home) so creditors cannot repossess them. It also stops harassing phone calls from collection agencies, lowers your interest rates, and sets you on a clear path toward becoming completely debt-free.

No. While under debt review, you are legally prohibited from taking on any new credit, including credit cards, clothing accounts, personal loans, or vehicle finance. This is to ensure you focus entirely on clearing your existing debts. The restriction is lifted once you pay off your restructured debt and receive a clearance certificate.

No. Debt review actually prevents adverse legal actions (like judgments or defaults) from ruining your record. While a flag is placed on your credit bureau profile to show you are under "Debt Review" (preventing you from opening new accounts), this flag is entirely removed once your clearance certificate is issued.

In almost all cases, no. Your debt counsellor works with an attorney to submit your restructured payment plan to either a Magistrate's Court or the National Consumer Tribunal to make it a legally binding order. Your personal presence in court is rarely required.

Missing a payment is dangerous because it violates the legal protection order. If you miss even a single instalment, credit providers have the legal right to terminate the debt review agreement and immediately initiate standard legal action or asset repossession. If you anticipate an emergency, you must contact your debt counsellor immediately before the payment window closes.
